TUI Airways compensation: UK261 and EU261 explained
We have handled 80 claims against TUI Airways, mostly holiday flights from Gatwick and Manchester to Cancún, Dalaman and Heraklion. If your TUI flight landed 3 hours or more late, was cancelled within two weeks of departure or you were refused boarding, you could be owed £220 to £520, or €250 to €600, per passenger, depending on where you flew from.
TUI Airways Limited, known as Thomson Airways until 2017, is based at Wigmore House in Luton and flies under the codes BY and TOM. It is a separate airline from TUI fly Belgium. Since Brexit it is a UK carrier, so two sets of rules apply. The UK's own version of the passenger rights law (often called UK261) covers every flight leaving a UK airport and TUI Airways flights coming back to the UK. Regulation (EC) 261/2004 covers flights departing from the EU, such as Tenerife to Manchester, and pays in euros.
Arrived late
Your TUI flight reached its destination 3 or more hours after the time on your booking.

Short noticeRefused boarding
You checked in on time with a confirmed seat and were still left behind.

How much TUI Airways pays on popular holiday routes
The price of your package is irrelevant. The distance and direction of the flight decide the amount.
| TUI Airways route | Rules | Amount |
|---|---|---|
| Manchester–Heraklion, Manchester–Dalaman, Dalaman–Manchester | UK261 | £350 |
| Gatwick–Cancún, Cancún–Manchester | UK261 | £520 |
| Palma–Gatwick (under 1,500 km) | EU261, departing the EU | €250 |
| Heraklion–Manchester, Tenerife–Manchester | EU261, departing the EU | €400 |
Short UK departures under 1,500 km pay £220 under UK261. Each passenger claims separately, children with a seat included: a family of four flying home from Cancún to Manchester 3 hours late could claim £2,080.
TUI Airways delay: what to do at the airport
Roughly 6 in 10 of our TUI Airways claims are delays, typically on late-night returns from Turkey, Greece and Mexico after the aircraft has fallen behind through the day. While you wait:
- Keep your TUI booking confirmation with the BY or TOM flight number; on a package it may be your only travel document.
- Ask the TUI rep or check-in desk what caused the delay.
- Note when the doors open on arrival back home.
- Keep receipts if no meal vouchers are given.
- Turn down holiday vouchers offered instead of cash.
Meals and hotels while you wait
Care is owed even when no compensation is due.
| Distance | Care after |
|---|---|
| Up to 1,500 km | 2 hours |
| 1,500–3,500 km | 3 hours |
| Over 3,500 km | 4 hours |
| Over 5 hours | You can choose not to travel and get a refund |
Missed connections
TUI Airways mostly flies direct, but if your flight was part of a single booking with a connection, the delay at the final destination is what counts. Read more about TUI Airways delay compensation.
TUI Airways cancelled flight: refund and compensation
About a quarter of our TUI Airways claims are cancellations. Accepting the new date your package was moved to does not cancel your right to compensation.
Always due: your money back or another flight to your destination.
Payable when notice came under 14 days before departure and the cause was not extraordinary.
| Notice | Compensation |
|---|---|
| 14 days or more | No; refund or new flight remain |
| 7 to 13 days | Yes, if the new flight left over 2 hours earlier or landed 4 hours or more late |
| Under 7 days | Yes, if the new flight left over 1 hour earlier or landed 2 hours or more late |
Charter retiming. Holiday flights are sometimes moved by several hours a few days before departure. EU case law can treat this as a cancellation. See TUI Airways cancellation compensation.
TUI Airways overbooking
More than 1 in 10 of our TUI Airways claims involve denied boarding, a high share for a holiday airline. If you were left behind without agreeing to it, compensation is due straight away, plus a new flight and care. Find out more about TUI Airways overbooking.
TUI Airways and strikes
Many TUI Airways flights to Spain, Greece and Turkey cross French airspace. A French air traffic control strike is outside the airline's control, so no compensation, though meals and rerouting are still owed. A strike by TUI Airways' own pilots or cabin crew is a different story: compensation is normally payable (case C-28/20).
TUI Airways rejected your claim? What holds up
Faults and maintenance are normal airline risks, unless the manufacturer flagged a hidden defect.
EU Court of Justice, case C-549/07A rolling delay is not enough by itself: TUI Airways must name the extraordinary event behind it.
TUI Airways staff: usually payable. Air traffic controllers or airport workers: not.
EU Court of Justice, case C-28/20Only if they genuinely hit your flight, which we check before replying.
TUI Airways, TUI fly and other TUI flights
The TUI brand covers several airlines, and the claim goes to the one that operated your flight:
- TUI Airways (BY/TOM): UK departures, with bases including Gatwick, Manchester, Birmingham, Bristol, Glasgow and Newcastle
- TUI fly Belgium (TB): a Belgian carrier, covered by EU rules on return flights too
- TUI Airways long haul on Boeing 787s to Mexico, the Caribbean, Mauritius and Thailand
- in peak summer some flights may use aircraft and crew from other airlines: check the operator on your booking
How to claim from TUI Airways: on your own or with us
TUI offers TUI Airways customers an online compensation claim form, linked from the help pages on tui.co.uk.
Free, but you have to work out whether UK or EU rules apply. If refused, you can contact the CAA for UK flights, the national enforcement body of the country where the flight departed for EU departures, or go to court.
Two minutes and an online signature. We pick the right rules and handle the claim, the formal demand and any court case with our lawyers. You pay only if you win: 25% + VAT. Legal costs are ours even if the case is lost.
Already turned down by TUI Airways?
Forward the reply to us: we review the reason and, if you are owed money, start again with a formal letter before action.
Documents to keep
- Package or flight confirmationShowing the TUI flight number.
- PassportsFor every traveller, children included.
- TUI messagesTexts, emails or notes from your resort rep.
Time limits
The deadline comes from national law, not the Regulation (EU Court of Justice, case C-139/11), so it depends where the claim is brought. A holiday from a few summers ago may still qualify: enter the date.
How long TUI Airways takes to pay
When TUI Airways accepts a claim, payment usually follows within a few weeks; a formal demand or court case adds several months. We transfer your share once we receive it.
Lost or damaged luggage on TUI Airways
Bags are covered by the Montreal Convention. Fill in a PIR at the airport before leaving, then write to the airline within 7 days for damage or within 21 days of delivery for a delayed case.
