Aeroméxico compensation: up to €600 on flights from Europe to Mexico
Aeroméxico, Mexico's flag carrier, flies from Mexico City to London Heathrow, Madrid, Barcelona, Paris, Amsterdam and Rome. We have handled more than 120 Aeroméxico claims, nearly all on long-haul routes such as Rome–Mexico City, Paris–Mexico City and Madrid–Mexico City. If your departure from Europe reached its destination at least 3 hours late, was cancelled at short notice or you were bumped, you may be owed €600 per passenger.
There is an important catch. Aeroméxico's legal entity, Aerovías de México, is based in Mexico City, so it is a non-EU airline. Regulation (EC) 261/2004 binds it only on flights taking off from the EU, Iceland, Norway or Switzerland. Your return flight from Mexico to Europe is not covered.

How much Aeroméxico pays: €600 on every transatlantic route
All Aeroméxico flights from Europe are longer than 3,500 km, so the top rate applies whatever cabin you flew or fare you paid.
| Aeroméxico flight leaving the EU | Distance | Compensation |
|---|---|---|
| Rome–Mexico City | 10,224 km | €600 |
| Barcelona–Mexico City | 9,481 km | €600 |
| Amsterdam–Mexico City | 9,206 km | €600 |
| Paris–Mexico City | 9,199 km | €600 |
| Madrid–Mexico City | 9,066 km | €600 |
Each passenger claims separately, including children with their own seat, so four people on a Paris–Mexico City flight landing 3½ hours late could claim €2,400. If you were connecting onwards to Cancún, Guadalajara or Monterrey, the final destination counts and the distance still exceeds 3,500 km.
Aeroméxico flight delayed: what to do
Nearly 6 in 10 Aeroméxico claims we receive are about delays. On a 12-hour crossing, one problem before boarding in Europe can cost you most of a day in Mexico. While you wait:
- Save your boarding pass in the Aeroméxico app or keep the printed copy.
- Screenshot every notification showing the new time and the stated reason.
- Record your arrival time at the final stop, not just in Mexico City.
- Ask the desk for meal vouchers and keep receipts for anything you buy.
- Do not swap your claim for Aeroméxico Rewards points without checking what you are owed.
Care at the airport before departure
On a long-haul flight, the duty of care starts after a 4-hour wait: meals, drinks and, if departure slips to the next day, a hotel and transfers.
| Situation | What you get |
|---|---|
| Wait of 4 hours or more (flights over 3,500 km) | Meals and drinks |
| Departure moved to the next day | Hotel and transfers |
| Delay over 5 hours | You can drop the flight and have your fare refunded |
Missed connection in Mexico City
Mexico City's Benito Juárez airport is where onward flights to the rest of Mexico and Latin America start, often on Aeroméxico Connect. If you left Europe on a single booking and reached your final stop 3 hours or more late, you are owed compensation even if the first flight was almost on time. More on our page about Aeroméxico delay compensation.
Aeroméxico flight cancelled
About 3 in 10 of our Aeroméxico claims involve a cancellation. Getting your money back and being compensated are two separate rights.
Choose between your fare back and another flight to the same destination.
If the flight left from the EU and you were told less than 14 days ahead.
| Notice received | Compensation |
|---|---|
| 14 days or more | Not due; refund or new flight still apply |
| 7 to 13 days | Due, unless the alternative leaves up to 2 hours early and lands within 4 hours of the original time |
| Under 7 days | Due, unless the alternative leaves up to 1 hour early and lands within 2 hours of the original time |
Rescheduled flight. If Aeroméxico shifts your Madrid–Mexico City flight by many hours just days before travel, it may count as a cancellation. See our page on Aeroméxico cancellation refunds.
Aeroméxico overbooking
At around 1 claim in 10, denied boarding features more often with Aeroméxico than with many airlines we deal with. If you were left at the gate in Paris or Amsterdam with a valid ticket and on-time check-in, the €600 is owed immediately, as well as a new flight. Nothing is due if your passport or travel documents were not in order. Read more on Aeroméxico overbooking and denied boarding.
Strikes and Aeroméxico
If your flight is cancelled because Aeroméxico pilots or cabin crew strike, compensation is normally payable: the EU Court of Justice regards a strike by an airline's own employees as an internal matter (case C-28/20). An air traffic control strike in France or Spain, by contrast, is extraordinary.
Aeroméxico turned down your claim? Typical replies
True if you flew out of Mexico. Wrong if your flight took off from Madrid, Paris or Rome.
Breakdowns are part of running an airline. Only hidden manufacturing defects disclosed by the manufacturer or authorities are exempt.
EU Court of Justice, case C-549/07A late arriving plane is not enough on its own: Aeroméxico must prove an extraordinary event at the root of it.
A valid excuse if it really stopped the departure; a vague reference is not.
What EU261 does not cover on Aeroméxico
Many travellers contact us about the Mexico City–Madrid return or flights within North America. These fall outside the EU Regulation:
- flights from Mexico to Rome, Madrid, Paris, Amsterdam or Barcelona
- Mexican domestic flights booked separately
- flights between Mexico and the US, including those under the Delta partnership
- flights from Mexico to London
UK departures and codeshares. Heathrow–Mexico City is covered by UK261, the British version of the rules, with amounts in pounds. If a flight sold with an AM code is operated by another SkyTeam airline, the operating carrier counts: if it is European, you are also covered on the way back.
How to claim from Aeroméxico
You can write to the airline yourself through the customer service section of aeromexico.com, quoting your booking reference and Regulation 261/2004.
Free, but the airline often replies citing Mexican rules. If it refuses, you turn to the national enforcement body of the country where the flight departed (the CAA for UK departures) or the courts.
A 2-minute form. We handle the claim, formal demand and court case with our own lawyers. Our fee is 25% + VAT, only if you get paid; legal costs are ours even if the case is lost.
Claim already rejected
If Aeroméxico has already said no, we can start from that letter and challenge it with the flight data.
Useful documents
- E-ticketWith the booking reference and full itinerary, connections included.
- PassportThe photo page for each traveller.
- Evidence of the disruptionAeroméxico emails, departure board photos, receipts.
Deadlines for an Aeroméxico claim
The Regulation has no deadline: the limitation period of the country where you claim applies, as the EU Court of Justice confirmed in case C-139/11. A trip to Mexico some time ago may still be recoverable: check the date.
How long Aeroméxico takes to pay
If the airline accepts, the money usually arrives within a few weeks. Where a formal demand or a court case is needed, allow a few months. Out of €600 you keep €417, transferred as soon as we receive it.
Lost or damaged luggage on Aeroméxico
On long-haul flights your bag is covered by the Montreal Convention. File a PIR at the baggage desk on arrival and claim from Aeroméxico within 7 days for damage, or within 21 days of delivery for a delayed bag.
