Trade Air compensation: your rights on flights in Croatia
Trade Air is a privately owned Croatian airline headquartered in Zagreb and founded in 1994. It does two kinds of flying: charters for tour operators and, under contract with the Croatian state, the domestic routes that link Osijek in the east with Zagreb and the Adriatic coast. If you hopped between Split, Dubrovnik and Osijek on holiday, there is a fair chance you were on a Trade Air plane.
Croatia is an EU member, so Trade Air is a European carrier. Regulation (EC) 261/2004 covers its domestic flights, every flight departing from the EU and charters flying back into Europe from outside it.

What Trade Air owes you
The price of the ticket is irrelevant; the amount is set by the distance flown.
| Distance | Examples | Payout |
|---|---|---|
| Up to 1,500 km | Osijek–Zagreb, Osijek–Split, Osijek–Dubrovnik and every other domestic route | €250 |
| 1,500 to 3,500 km | Charters from Croatia to Egypt | €400 |
| Over 3,500 km | Hardly ever flown by Trade Air | €600 |
The money is per person: three of you on an Osijek–Dubrovnik flight that lands four hours late means €750. Children with their own seat get the same as adults.
Trade Air delay: what to do at the airport
Croatia's regional airports are small and updates are often given by word of mouth, so:
- Photograph your boarding pass showing the C3 code.
- Ask for the reason in writing at the airline or handling desk.
- Note when the doors open at your destination.
- Keep receipts for snacks, meals, taxis and hotels.
- Do not sign away your rights in exchange for vouchers.
Care you are owed
| Route length | Meals and drinks from |
|---|---|
| Up to 1,500 km | 2 hours |
| 1,500-3,500 km | 3 hours |
| Over 3,500 km | 4 hours |
| From 5 hours | You may abandon the trip and get the fare back |
If the wait runs overnight, Trade Air must pay for a hotel and the transfer to it.
Multi-stop flights
Trade Air's domestic network has included flights with an intermediate stop, such as Osijek–Pula–Split. On a single ticket, only the delay at your final stop counts. Read more on Trade Air delay compensation.
Trade Air flight cancelled: what you can claim
Your choice, in every case.
When the cancellation reached you less than 14 days before the flight.
| When you were told | Compensation |
|---|---|
| 14 days or more ahead | No |
| 7-13 days ahead | Yes, if the replacement leaves over 2 hours earlier or lands 4 hours or more later |
| Under 7 days ahead | Yes, if the replacement leaves over 1 hour earlier or lands 2 hours or more later |
The 2026 gap. Croatia's contract for subsidised domestic flights expired at the end of March 2026, and Trade Air halted those routes until 20 July 2026, when the Osijek services restarted. If your flight was cut in that window, what matters is when you were told. See Trade Air cancellation compensation.
Bumped by Trade Air
Turned away because the flight was overbooked? You are owed compensation on the spot plus another flight. Missing travel documents are a different story. Full details on Trade Air overbooking.
Strikes and Trade Air
If Trade Air's own pilots or cabin crew walk out, the airline still pays: the EU Court of Justice sees it as an internal matter (case C-28/20). A strike by Croatian air traffic control, by contrast, is an outside event.
Trade Air said no? Which excuses hold up
A small fleet means one breakdown grounds a lot, but that remains the airline's risk.
EU Court of Justice, case C-549/07Payable if its own staff struck, not if controllers did.
EU Court of Justice, case C-28/20Contract and planning issues are not extraordinary circumstances.
Only valid if the weather really stopped the flight at that airport; we check.
Subsidised domestic routes
The Croatian state funds a handful of routes that are vital for connections but not profitable on their own. Trade Air flies the ones from Osijek to Zagreb, Pula, Rijeka, Zadar, Split and Dubrovnik. A subsidy does not shrink your rights: the same rules apply as on any commercial flight. Trade Air has also flown services on behalf of Croatia Airlines in the past.
Claiming from Trade Air: two routes
You write to the airline yourself and, if refused, turn to the national enforcement body of the country you flew from, or the courts, at your own expense.
A two-minute form and an e-signature; our own lawyers deal with formal demands and court. Success fee only: 25% + VAT, so €173.75 of €250 is yours. We cover legal costs even if we lose.
Documents
- Trade Air ticketConfirmation or boarding pass.
- IDPassport or ID card for every traveller.
- EvidenceTexts, emails and receipts.
How long you have
The Regulation sets no deadline; national law where you sue decides (EU Court of Justice, case C-139/11). Tell us the date and we will check.
When the money arrives
If the airline says yes, expect payment within a few weeks. Legal action adds a few months. We email you whenever something changes.
Bags and Trade Air
Lost or damaged luggage falls under the Montreal Convention. File a PIR at the baggage desk and send your claim within 7 days for damage or 21 days after the bag is returned for a delay.
