Emirates compensation: who can claim and on which flights
We have handled more than 300 Emirates claims for over 400 passengers, and the routes that come up most are Manchester, London Heathrow and London Gatwick to Dubai, followed by onward journeys to Bangkok and Sydney. On flights of this length, if Emirates gets you to your final destination three hours late, cancels at short notice or bumps you off an oversold flight, the amount at stake is usually the top band: €600 per passenger under EU rules, or £520 under the UK version.
The key point is where you took off. Emirates is the flag carrier of Dubai, owned through the Emirates Group by the Dubai government, so it is not a European airline. Regulation (EC) No 261/2004 binds it only on flights departing from an airport in the EU, Iceland, Norway or Switzerland, and the retained UK regulation does the same for departures from Britain. Manchester–Dubai is covered; Dubai–Manchester is not.
Delayed flight
Your journey began in the UK or Europe and you reached your final destination, after any change in Dubai, three hours or more behind schedule.
3 hours at final arrivalCancelled flight
Emirates scrapped a departure from the UK or Europe and told you less than two weeks beforehand, with no comparable alternative.
Under 14 days' noticeOverbooking
You checked in on time with a confirmed seat and were refused boarding without volunteering to give it up.
Owed at the gateWhen it is not owed
When the flight departs Dubai or another non-European airport, or when Emirates proves an event outside its control, such as a closed airspace.

How much Emirates pays: amounts on real routes
It makes no difference whether you flew Economy or First on the A380: the amount is fixed by law and depends only on the distance from your first departure airport to your final destination.
| Emirates route | Position | Amount |
|---|---|---|
| Manchester–Dubai, London Heathrow–Dubai, London Gatwick–Dubai | Covered by UK261, over 3,500 km | £520 |
| London–Dubai–Bangkok on one booking | Covered by UK261: London is the starting point | £520 |
| Dublin–Dubai, Milan–Dubai | Covered by EU261, over 3,500 km | €600 |
| Dubai–Manchester, Bangkok–Dubai, Sydney–Dubai | Not covered: departs outside Europe | Not owed |
The amount is per passenger, so a family of four on a Manchester–Dubai–Mauritius trip that arrived six hours late could claim four times over. Children with their own seat count in full. In our form, add the flight once and then list everyone travelling with you.
Delayed Emirates flight: what to do
More than 7 in 10 of our Emirates claims are about delays. The usual pattern: the departure from Manchester or Gatwick leaves late, the connection in Dubai has gone, and the next available seat to Bangkok or Sydney is hours later. What matters is when the aircraft door opens at your final stop. While you wait:
- Keep every boarding pass, including the replacement one printed at the Dubai transfer desk.
- Screenshot the Emirates app showing the flight status and any rebooking notices.
- Ask for the reason in writing: a note from the transfer desk or an email carries more weight than a verbal explanation.
- Write down the actual arrival time at your final destination, not just at Dubai.
- Think twice about Skywards Miles offered as a goodwill gesture: compensation is a cash right unless you agree otherwise in writing.
Meals and hotels Emirates must provide
On covered flights, care is owed even where compensation is not. If you are stranded in Dubai on a journey that began in Europe or the UK on a single booking, Emirates must arrange food, drinks and, overnight, a hotel with transport.
| Flight distance | Care from |
|---|---|
| Up to 1,500 km | 2 hours |
| 1,500 to 3,500 km | 3 hours |
| Over 3,500 km, which covers nearly every Emirates flight from Britain | 4 hours |
| Delay of 5 hours or more | You may abandon the trip and get the fare back |
Missed connection in Dubai
A Gatwick–Dubai flight and a Dubai–Bali flight bought together are one journey that started in the UK: the delay is measured in Bali and the band is set by the total distance, even if the hold-up happened on the second leg. If you bought the Dubai sector separately, that flight sits outside the rules. Read more about compensation for a delayed Emirates flight.
Cancelled Emirates flight: refund and compensation
Around 1 in 5 of our Emirates cases involve a cancellation. Emirates normally offers a new flight or a refund straight away; accepting either does not cost you any compensation you are owed, because the two are separate rights.
Always available: choose a new routing to your final destination or your money back for the unused sectors.
On top of that, if the flight departed from Europe or the UK and you were told less than 14 days before.
| Notice given | Compensation |
|---|---|
| Two weeks or more | Not owed; refund or rebooking still apply |
| 7 to 13 days | Owed, unless the replacement leaves no more than 2 hours earlier and lands less than 4 hours late |
| Under 7 days | Owed, unless the replacement leaves no more than 1 hour earlier and lands less than 2 hours late |
Retimed departures. When Emirates moves a UK or European departure by several hours shortly before travel, the change can count as a cancellation. See the guide to compensation for a cancelled Emirates flight or check your case now.
Emirates overbooking and denied boarding
It is uncommon, about 3 in 100 of our Emirates claims, but it does happen at peak times to Dubai and the Indian Ocean. If you were refused boarding against your will having checked in on time, compensation is due at once alongside a replacement flight. It is not owed when the reason lies with you, such as a missing visa for your final destination. More in our page on Emirates overbooking and denied boarding.
Strikes and Emirates flights
Industrial action that disrupts Emirates passengers in Europe usually comes from outside the airline: air traffic control, ground handlers or airport security. In that case Emirates does not owe compensation but still has to provide care, rebooking or a refund. A walkout by the airline's own staff would be different: the Court of Justice of the EU treats strikes by an airline's employees as part of its normal business risk (case C-28/20).
Emirates rejected your claim? How to respond
Emirates refusal letters tend to rely on a handful of stock phrases. This is how we assess them.
Checks and repairs are part of running an airline, on a Boeing 777 as much as anywhere. Have your flight checked.
Court of Justice of the EU, case C-549/07If that sector was on the same booking as your departure from Europe or the UK, the final arrival counts and the refusal is wrong. On a separate ticket, Emirates is right.
A strike by Emirates staff does not excuse the airline; one by controllers or airport workers does.
Court of Justice of the EU, case C-28/20These are outside events, but they must have affected your flight on that day. We compare dates and times with what actually happened in Dubai.
Flights into Britain and Europe: what is not covered
The main gap is the return leg. Neither EU261 nor UK261 covers:
- Dubai–Manchester, Dubai–London or Dubai–Glasgow
- Bangkok–Dubai–London or Sydney–Dubai–Manchester, even on a single booking
- New York–Milan, because it departs the United States
For these flights, the rules of the departure country or, for proven losses, the Montreal Convention may help. The Milan–New York service that Emirates runs from Malpensa is a different story: departing Italy, it is covered by EU261 at €600.
Dubai hub, Skywards, flydubai and the 2026 airspace closure
Almost the whole Emirates network runs through Terminal 3 at Dubai International. Some routes sold under the EK code are flown by flydubai, a partner airline also based in Dubai; the same non-European rules apply. The airline is not part of any of the big global alliances, so check your booking for who actually operates each leg.
Spring 2026. Between late February and May 2026, the Gulf conflict led to the closure or restriction of UAE airspace and Emirates suspended or cut many flights. Compensation is not normally owed for those cancellations, as they are extraordinary circumstances, but a refund or rebooking and care during the wait still are. If your disruption had another cause, it is worth checking.
How to claim from Emirates: on your own or with us
You can write to Emirates through the feedback and complaints form in the help section of emirates.com, giving your booking reference, flight numbers and passenger names.
It costs nothing, but you have to argue the point yourself, especially on connections through Dubai. If Emirates holds firm, you can go to the national enforcement body of the country where the flight departed, which for UK departures is the CAA, or to the small claims court.
Two minutes to fill in the form and sign online. We rebuild every leg of the journey, deal with Emirates and, if needed, go to court with our own lawyers. You pay only if you are paid: 25% + VAT. Legal costs are ours, even if the case is lost.
Already turned down?
Send us the Emirates reply with your ticket. We check whether the journey began in Europe or the UK and whether the cause given really was outside the airline's control; if not, the claim restarts with a formal demand.
What to have ready
- E-ticket and boarding passesEvery leg, including the flight after Dubai.
- PassportFor each traveller, children included.
- Messages and receiptsEmirates app alerts, rebooking emails, spending receipts.
How long you have to claim
The Regulation sets no deadline of its own: the national law of the country where you bring the claim decides, as the Court of Justice of the EU confirmed (case C-139/11). A trip to Dubai from a while ago may still be in time. Enter the date and we will tell you.
How long Emirates compensation takes
When Emirates accepts the claim straight away, payment usually arrives within a few weeks. If it cites extraordinary circumstances and we need a formal demand or court action, allow several months. We update you at every step and pay your share by bank transfer once the money lands: from €600 you receive €417.
Lost or damaged luggage with Emirates
On trips connecting in Dubai, bags sometimes miss the transfer. Luggage falls under the Montreal Convention, not Regulation 261: report it at the arrival airport's baggage desk with a Property Irregularity Report (PIR), then complain in writing within 7 days for damage or within 21 days of getting the bag back for a delay.
