Gol compensation: when EU rules cover your trip
Gol Linhas Aéreas is one of Brazil's largest airlines. For years, travellers from Europe reached its network by connecting from an Air France, KLM or TAP flight; since September 2026 Gol has also flown its own aircraft between Rio de Janeiro and Lisbon. We have already handled claims for more than 30 Gol passengers, and each starts with one question: does EU law apply?
Gol is a Brazilian, non-EU carrier. Under Regulation (EC) 261/2004 it only owes compensation on flights departing from the EU, Iceland, Norway or Switzerland. A Lisbon–Rio flight operated by Gol is covered; the Rio–Lisbon return is not, and neither are Brazilian domestic flights or a Bogotá–São Paulo service. The big exception: on a single booking that started in Europe, what matters is arrival at your final destination, even if the disruption happened on the Brazilian connection.
Delayed flight
Journey started in Europe and you reached your final airport, such as Foz do Iguaçu, 3 hours or more late.
European departures onlyCancelled flight
Gol told you less than 14 days before departure that your flight from Europe would not operate.
Late noticeOverbooking
You were refused boarding at a European airport despite a valid ticket and arriving at the gate on time.
Due immediatelyWhen it doesn't apply
Gol flights leaving from outside Europe, or events genuinely beyond the airline's control.

How much Gol pays: amounts on the trips we see
Between Europe and South America the distance is almost always over 3,500 km, so the figure is €600 per passenger, however cheap the fare was. This is where the Gol routes in our cases fall:
| Journey | Covered by the Regulation | Amount |
|---|---|---|
| Paris–Foz do Iguaçu, connecting on one booking | Yes, departs from the EU | €600 |
| Bilbao–Asunción, connecting on one booking | Yes, departs from the EU | €600 |
| Lisbon–Rio de Janeiro, direct Gol flight | Yes | €600 |
| Rio de Janeiro–Lisbon, Bogotá–São Paulo | No, non-EU carrier departing outside Europe | – |
| São Paulo–Jericoacoara, São Paulo–Foz do Iguaçu | Only as a connection on a trip that began in Europe | Based on the whole trip |
Compensation is per person. A couple travelling with two children on a Paris–Foz do Iguaçu itinerary that landed 5 hours late is owed €2,400 in total, as children with their own seat receive the same as adults. On our form you add the flight once and then list your fellow passengers.
Delayed Gol flight: what to do between Europe and Brazil
Around 3 in 4 Gol claims we receive involve a delay. It is measured when the doors open at your final airport, not at the hub: missing a connection at Guarulhos can easily turn a one-hour delay into half a day. While you wait:
- Photograph every boarding pass, including the domestic Brazilian leg.
- Keep the Gol app notifications and emails giving the reason, even if they are in Portuguese.
- Ask the Gol desk for the cause and the new departure time, in writing if possible.
- Hold on to receipts for meals, taxis and hotels you paid for yourself.
- Don't accept Smiles miles or vouchers instead of cash before you know what you are owed.
Care Gol must provide while you wait
On covered flights, Gol must offer meals and refreshments and, if you can only fly the next day, a hotel and transfers.
| Flight distance | Care after |
|---|---|
| Up to 1,500 km | 2 hours |
| 1,500 to 3,500 km | 3 hours |
| Over 3,500 km | 4 hours |
| Delay of 5 hours or more | You may cancel the trip and get a refund |
Missed connection in Brazil
With one booking and an arrival 3 hours or more late, compensation is based on the full distance; with separate tickets, the Brazilian flight falls outside the rules. More on our page about a delayed Gol flight.
Cancelled Gol flight: refund and compensation
You choose between getting the fare back and an alternative flight to the same destination.
Added on top when notice came less than 14 days ahead and the cause lay with Gol.
| Notice given | Compensation |
|---|---|
| 14 days or more | No, but refund or rerouting still apply |
| 7 to 13 days | Yes, unless the replacement leaves no more than 2 hours early and lands less than 4 hours late |
| Under 7 days | Yes, unless the replacement leaves no more than 1 hour early and lands less than 2 hours late |
New routes, shifting timetables. Gol's European services have only just started, so schedules may move. A big retiming announced shortly before departure can count as a cancellation. Full details on our cancelled Gol flight page.
Gol overbooking: denied boarding in Europe
More than 1 in 10 of the Gol claims we handle concerns denied boarding. If it happened in Lisbon or at another European airport on a Gol-operated flight, compensation is due straight away, alongside a new flight or a refund. If you were bumped in São Paulo or Rio, Brazilian rules apply instead. Read our guide to Gol overbooking and denied boarding.
Strikes and Gol flights
If a Gol flight from Lisbon is cancelled because the airline's own pilots or cabin crew walk out, compensation is normally payable: the EU Court of Justice treats this as part of an airline's ordinary business (case C-28/20). A walkout by air traffic controllers or airport staff is an extraordinary circumstance: no compensation, but care is still owed.
Gol rejected your claim? The usual replies
The departure airport is what counts, not the airline's flag. If the trip took off in Europe, Gol must follow EU rules.
Faults and maintenance are part of normal operations, unless a hidden defect is reported by the manufacturer or authorities.
EU Court of Justice, case C-549/07On one booking from Europe, final arrival counts. On separate tickets, it doesn't.
Only extraordinary if it really grounded that flight, which we check.
Gol in Europe: Lisbon, Paris and partner flights
Since 16 September 2026 Gol has linked Rio de Janeiro-Galeão and Lisbon with an Airbus A330 leased with crew from Wamos Air, and it has announced a route to Paris-Charles de Gaulle. Many trips sold by Gol, however, are flown by Air France or KLM. In practice:
- Lisbon → Rio on a Gol flight: covered
- Rio → Lisbon on a Gol flight: not covered
- flights sold by Gol but operated by Air France or KLM: the claim goes to them, and as EU airlines they are covered on the return to Europe too
- domestic flights in Brazil: covered only as a connection on a trip that began in Europe on the same booking
Gol belongs to Abra, the holding company that also controls Avianca. Its main hubs are São Paulo-Guarulhos, São Paulo-Congonhas, Brasília and Rio-Galeão.
How to claim from Gol: on your own or with us
Gol handles complaints through the help section of voegol.com.br, which is designed mainly for Brazilian customers.
It's free, but you write to Gol, often in Portuguese or English, explain why the Regulation applies and deal with any refusal. After that, your options are the national enforcement body of the country where the flight departed or the civil courts.
Two minutes and an online signature. We handle the claim, the formal demand and court action with our own lawyers. You pay only if you win: 25% + VAT. Legal costs are ours, even if the case is lost.
If Gol has already turned you down
You can still pass the case to us after a first refusal: where it is unfounded, we start with a formal letter before action.
Documents to have ready
- Full bookingEvery leg, including those flown by partners.
- Passport or IDFor each passenger, children included.
- Messages from GolDelay or cancellation notices and receipts.
Time limit for a Gol claim
The Regulation sets no deadline: the law of the country where you bring the claim decides, as the EU Court of Justice confirmed (case C-139/11). Was your Brazil trip a while ago? Enter the date and we will tell you whether you are still in time.
How long Gol compensation takes
If Gol accepts the claim, payment usually arrives within a few weeks. If a formal demand or court case is needed, allow a few months. Once the money reaches us, we transfer your share to your bank account.
Lost or damaged luggage with Gol
Baggage is governed by the Montreal Convention, which Brazil has also ratified. File a Property Irregularity Report (PIR) at the arrival airport and send your claim to Gol within 7 days for damage and within 21 days of delivery for delayed bags.
