In short

  • Delay: if you arrive 3 hours or more late, Air Serbia owes €250 to €600 per person, depending on the distance.
  • Cancellation: you are owed compensation if you were told less than 14 days before departure, on top of a ticket refund or an alternative flight.
  • Not owed for extraordinary circumstances (severe weather, air traffic control strikes). Technical faults and strikes by the airline's own staff usually are not extraordinary.
  • With DelayFlight24 you pay nothing upfront: if Air Serbia pays, you keep €173.75 out of €250 or €278 out of €400.

Air Serbia compensation: which flights qualify

We have handled more than 80 Air Serbia claims, many of them on flights into Belgrade from Paris, Barcelona, Rome, Athens and London. If your Air Serbia flight left an airport in Europe and reached its destination 3 hours or more late, was cancelled at short notice or left you behind at the gate, you may be owed €250, €400 or €600 per passenger.

There is one catch. Air Serbia, the Serbian flag carrier that took over from Jat Airways in 2013, is based in Belgrade, outside the European Union. Under Regulation (EC) 261/2004 it only owes compensation on flights departing from the EU, Iceland, Norway or Switzerland. Rome to Belgrade is covered; Belgrade back to Rome is not.

Long delay

You set off from Europe and landed at your final destination, even after changing planes in Belgrade, at least 3 hours late.

3 hours at final arrival

Cancellation

Air Serbia scrapped a flight leaving the EU and told you less than two weeks beforehand.

Under 14 days' notice

Denied boarding

The flight was full and you were turned away at a European airport against your will.

Due on the day

Not covered

Departures from Serbia or other non-EU countries, and disruption caused by a genuine extraordinary event.

Non-EU departures

How much Air Serbia pays per passenger

The fare is irrelevant. What matters is the distance from your European departure airport to your final destination.

Distance Air Serbia routes from the EU Compensation
Up to 1,500 km Paris–Belgrade, Kraków–Belgrade, Rome–Belgrade, Athens–Belgrade €250
1,500–3,500 km Madrid–Belgrade, Lisbon–Belgrade €400
Over 3,500 km Rome to New York via Belgrade, booked as one trip €600

Every traveller on the booking has their own claim, and a child with a seat counts like an adult. A family of four flying Rome to New York via Belgrade and landing 4 hours late could claim €2,400.

Flying from London? London–Belgrade departures fall under the UK's own version of the rules, with amounts in pounds (Ā£350 on this distance). Belgrade–London on Air Serbia is covered by neither.

Air Serbia flight delayed: steps to take

More than 7 in 10 of our Air Serbia cases are delays, and the real damage is usually done in Belgrade, where a late inbound leg means a missed onward connection. While you wait:

  1. Keep both boarding passes if you connected in Belgrade: they show it was one journey.
  2. Write down your actual landing time at the final destination.
  3. Ask the transfer desk why the flight is late and keep any written notice.
  4. Save receipts for meals, taxis or a hotel if no vouchers were provided.
  5. Refuse vouchers in place of cash until you know what you are owed.

Meals and accommodation from Air Serbia

On flights out of the EU, care is owed even when compensation is not.

Flight distance Meals and drinks after
Up to 1,500 km 2 hours
1,500–3,500 km 3 hours
Over 3,500 km 4 hours
Delay of 5 hours or more You may abandon the trip and get your fare back

Missed connection in Belgrade

On a single booking that began in the EU, the delay is measured at the final destination, even outside Europe: Paris–Belgrade–Chicago arriving 3 hours late in Chicago qualifies. Two separate tickets mean the Belgrade leg stands alone and is not covered. More on our page about Air Serbia delay compensation.

Air Serbia flight cancelled: refund plus compensation

A cancelled departure from Europe gives you two separate rights.

Your money back or a new flight

You choose: a full refund or rerouting to your destination, if needed on another airline.

€250 to €600 on top

Payable when the notice came less than 14 days ahead and the cause was not extraordinary.

Notice given Compensation
14 days or more No, but refund or rerouting still apply
7 to 13 days Yes, unless the new flight left no more than 2 hours early and landed under 4 hours late
Under 7 days Yes, unless the new flight left no more than 1 hour early and landed under 2 hours late

Retimed departure. When Air Serbia moves your flight by several hours shortly before travel, the EU Court of Justice can treat it as a cancellation. See Air Serbia cancellation compensation.

Air Serbia overbooking and denied boarding

About 7 in 100 of our Air Serbia claims involve passengers who were bumped. If it happens at Paris, Rome or another European airport and you did not give up your seat voluntarily, compensation is due immediately, along with a new flight and care. Read our guide to Air Serbia overbooking.

Air Serbia strikes: who walked out matters

A strike by Air Serbia's own pilots or cabin crew is, for the EU Court of Justice, part of running an airline, so compensation is normally owed (case C-28/20). A French air traffic control strike is a different matter: it lies outside the airline's control, so there is no payout, though meals, a hotel if needed and rerouting remain due.

Air Serbia rejected your claim? How the usual reasons hold up

Usually payable
"A technical problem with the aircraft"

Breakdowns are part of operating a fleet. Only hidden defects flagged by the manufacturer or regulators are an exception.

EU Court of Justice, case C-549/07
Usually payable
"The inbound aircraft from Belgrade was late"

A knock-on delay is not extraordinary by itself. Air Serbia has to identify the event that started it.

Depends
"Industrial action"

Airline staff on strike: payable. Air traffic controllers or airport workers: not.

EU Court of Justice, case C-28/20
Often not payable
"Fog in Belgrade" or "ATC restrictions"

Only valid if they actually affected your flight at that time.

Already turned down by Air Serbia? Forward us the reply. If the reason does not stand up, we dispute it in writing and go to court if necessary. Check your Air Serbia flight.

Air Serbia flights outside EU rules

Because Air Serbia is not an EU airline, the European compensation scheme does not reach these journeys:

  • return flights from Belgrade, NiÅ” or Kraljevo to the UK and the rest of Europe
  • Belgrade to Moscow and other non-EU destinations
  • New York, Chicago, Shanghai or Guangzhou to Belgrade

Departures from Serbia are governed by Serbian law, which Air Serbia refers to in its own conditions. That is not the EU Regulation, so each case has to be assessed on its own facts.

How to claim from Air Serbia: on your own or with us

You can write to Air Serbia yourself through the "Claims" section of airserbia.com, quoting your booking reference and flight number.

On your own

Free, but you handle the back-and-forth. If the answer is no, your next steps are the national enforcement body of the country where the flight departed, or the courts, at your own cost and time.

With DelayFlight24

Two minutes to fill in, one online signature. We send the claim, the formal demand and, if needed, go to court with our own lawyers. You pay only if you win: 25% + VAT. We cover legal costs even if the case is lost.

Already rejected by Air Serbia?

A first refusal is not the end. If your flight left the EU and the reason given does not hold, we restart with a formal letter before action.

What to have ready

  • E-ticketShowing every leg, especially the Belgrade connection.
  • Passport or IDFor each passenger, children included.
  • Airline messagesRebooking emails, cancellation notices and expense receipts.

Time limits for an Air Serbia claim

The Regulation sets no deadline. National law decides, as the EU Court of Justice confirmed in case C-139/11, so the limit varies by country. Older flights are often still claimable: enter your date and we will tell you.

How long Air Serbia takes to pay

If Air Serbia accepts the claim, payment usually arrives within a few weeks. If it refuses, a formal demand and possibly court action add several months. We then transfer your share.

Lost or damaged luggage on Air Serbia

Bags come under the Montreal Convention, not Regulation 261. Report the problem at the airport with a Property Irregularity Report (PIR), then claim in writing within 7 days for damage, or within 21 days of getting the bag back for a delay.

Air Serbia compensation: frequently asked questions

Is Air Serbia covered by EU261 compensation rules?
Only partly. Air Serbia is a Serbian airline, so Regulation 261/2004 applies only to its flights departing from the EU, Iceland, Norway or Switzerland. Flights from Belgrade to Europe are not covered by the EU rules.
My flight from London to Belgrade was 4 hours late. Can I claim?
Yes, under the UK's version of the rules, which covers every flight leaving a UK airport. On a distance like London–Belgrade the amount is Ā£350 per passenger. The return from Belgrade to London on Air Serbia is not covered.
How much compensation does Air Serbia pay?
€250 per passenger up to 1,500 km, such as Paris–Belgrade, €400 between 1,500 and 3,500 km, such as Madrid–Belgrade, and €600 above 3,500 km, for example Rome to New York via Belgrade on one booking. You need to reach your final destination at least 3 hours late.
I missed my connection in Belgrade. Am I owed anything?
If the whole trip was one booking starting in the EU and you arrived at your final destination 3 hours or more late, yes. The amount is based on the distance from your first departure airport to your final destination. With separate tickets, the leg from Belgrade is not covered.
Air Serbia refunded my cancelled flight. Can I still get compensation?
Possibly. If the cancelled flight was leaving the EU and you were told less than 14 days before departure, you can claim €250 to €600 on top of the refund, unless the cause was extraordinary.
Does a technical fault let Air Serbia off paying?
Usually not. The EU Court of Justice ruled in case C-549/07 that technical problems are part of an airline's normal operations. Only hidden manufacturing defects reported by the maker or authorities are an exception.
Does my Elevate or Etihad Guest membership affect my claim?
No. Elevate, which replaced Etihad Guest as Air Serbia's loyalty programme in 2026, has nothing to do with your rights under the Regulation. Compensation is owed in cash to every eligible passenger, member or not.
How long do I have to claim from Air Serbia?
The Regulation does not set a deadline. National law applies, as the EU Court of Justice confirmed in case C-139/11, so it depends on the country where you bring the claim. Enter your flight date and we will tell you if you are still in time.
What does DelayFlight24 charge for an Air Serbia claim?
Nothing upfront. If we recover the money, our fee is 25% + VAT: you keep €173.75 of €250, €278 of €400 and €417 of €600. If the case goes to court, we cover all legal costs, even if it is lost.
