Azur Air Ukraine compensation: the airline now flies as Skyline Express
You will not find Azur Air Ukraine on a departures board any more. The Ukrainian charter airline, founded in 2008 as UTair-Ukraine and owned by the Anex tourism group, has traded as Skyline Express since 2023. With Ukrainian airspace closed since February 2022 it no longer flies from Kyiv-Boryspil. Instead it operates package-holiday flights from Polish airports such as Warsaw, Katowice, Poznań and Rzeszów to Egypt, Turkey, Greece and Bulgaria. We still take on claims for older Azur Air Ukraine flights.
Because the carrier is Ukrainian, and therefore non-EU, Regulation (EC) 261/2004 only applies to flights departing from an airport in the EU, the European Economic Area or Switzerland. That is exactly why today's flights out of Poland are fully covered.

How much Skyline Express (formerly Azur Air Ukraine) pays
A cheap package or an expensive one makes no difference: the amount depends only on the distance to your destination.
| Distance | Type of flight | Amount |
|---|---|---|
| Up to 1,500 km | Poland to Bulgaria's Black Sea coast | €250 |
| 1,500 to 3,500 km | Poland to Turkish and Egyptian resorts | €400 |
| Over 3,500 km | Poland to the Caribbean | €600 |
Every traveller receives the full amount, children with their own seat included, so a family of four on a delayed flight to the Turkish coast could be owed €1,600.
Delayed charter: your rights and what to keep
Night departures and delays of several hours are common on holiday charters. Keep the tour operator voucher, your boarding pass and any messages with new times. After 2, 3 or 4 hours (depending on distance) the airline must offer meals and, if needed, a hotel; beyond 5 hours you may decide not to fly and get your money back. For a single booking with a connection, the delay counts at the final destination. More on our page about the delayed Azur Air Ukraine flight.
Azur Air Ukraine flight cancelled
A refund or alternative flight is always due; compensation on top only if the flight left the EU and you had under 14 days' notice. The sudden closure of Ukrainian airspace in February 2022 was an extraordinary circumstance: for those flights from Kyiv you can claim a refund, not compensation. Overbooking on Skyline Express
If you were turned away from a flight out of Warsaw or Katowice despite having everything in order, compensation is due straight away. Full guide to Azur Air Ukraine overbooking.
Crew strikes and air traffic control strikes
A strike by the airline's own pilots or cabin crew normally does not let it off (case C-28/20); one by Polish or Greek air traffic controllers does.
Skyline Express said no: is it justified?
A technical fault is part of ordinary fleet management and is not enough on its own.
EU Court of Justice, case C-549/07A package does not change who pays: compensation is owed by the airline that operated the flight.
Not the same airline as Azur Air
Despite the similar name, Azur Air Ukraine should not be confused with the Russian airline Azur Air: the rebrand to Skyline Express was partly meant to set the two apart.
How to make a claim
You can write to the airline or your tour operator yourself and, if that fails, go to the national enforcement body of the country where the flight departed, which for Poland is the Polish civil aviation authority, or to court. Or you hand the case to us: sign online, nothing up front, 25% + VAT only if we win (you keep €173.75 out of €250), and legal costs on us even if the case is lost. You need your voucher or boarding pass and ID for each passenger. Time limits follow national law (case C-139/11): enter the date and check.
Payment times
If the airline accepts, a few weeks is usually enough; a formal demand or court action adds a few months.
Luggage and contacts
Bags are covered by the Montreal Convention: fill in a PIR before leaving the airport, then complain within 7 days for damage and within 21 days for delay.
