Air Transat compensation: when you can claim €600 on flights from Europe to Canada
Air Transat is the Montreal-based leisure airline that links Toronto and Montreal with Europe, mostly on seasonal routes from spring to autumn. We have already helped more than 35 Air Transat passengers, almost all of them on transatlantic sectors from Rome, Lisbon, Faro and Porto. At these distances Regulation (EC) 261/2004 sets the highest fixed amount: €600 per passenger.
There is one catch you need to know about. Air Transat is a Canadian carrier, not an EU one, so the regulation only applies to its flights departing from an airport in the EU, Iceland, Norway or Switzerland. Rome to Toronto is covered; the return leg from Toronto to Rome is not.
Late arrival
Your flight from Europe reaches Canada, or your final destination, three hours or more behind schedule.
3+ hours at arrivalCancellation
Air Transat scraps the European departure and tells you less than two weeks before you fly.
Under 14 days' noticeBumped from the flight
The aircraft is full and you are refused boarding, despite a confirmed seat and turning up on time.
Payable straight awayNo compensation
Flights leaving Canada, or a genuinely extraordinary cause, such as a storm or closed airspace, that the airline can prove.

How much Air Transat pays on transatlantic routes
Every route between Europe and Canada is longer than 3,500 km, so on Air Transat the figure is almost always the same: €600 per person, whatever you paid for the ticket and whether you sat in Economy or Club Class.
| Air Transat route | Distance | Compensation |
|---|---|---|
| Rome–Toronto | About 7,000 km | €600 |
| Rome–Montreal | About 6,500 km | €600 |
| Faro–Toronto | About 5,900 km | €600 |
| Lisbon–Toronto | About 5,700 km | €600 |
| Porto–Montreal | About 5,100 km | €600 |
These are the routes our customers claim on most often. Each traveller on the booking has their own claim, so a couple with two children delayed five hours on Lisbon–Toronto are owed €2,400 between them. Children with their own seat count in full; infants on a parent's lap do not.
Air Transat flight delayed: what to do at the airport
Roughly two in three of the Air Transat cases we handle start with a delay. What matters is the moment the aircraft door opens in Toronto or Montreal, not the touchdown time. While you wait:
- Keep your boarding pass, paper or in the Air Transat app, as proof you were on board.
- Ask the desk why you are delayed and write down what you are told and when.
- Save every email and text Air Transat sends, including gate changes.
- Note your real arrival time once you are off the plane in Canada.
- Turn down travel credits offered in exchange for giving up cash compensation.
Meals and hotels Air Transat must provide
Care is owed even when the delay has an extraordinary cause. On every route to Canada it kicks in after four hours.
| Flight length | Meals and drinks from |
|---|---|
| Up to 1,500 km | 2 hours |
| 1,500 to 3,500 km | 3 hours |
| Over 3,500 km (all Canada routes) | 4 hours |
| Wait of 5 hours or more | You may cancel the trip and get the fare back |
Missed connection in Toronto or Montreal
Plenty of passengers fly on to Vancouver or Calgary on the same booking. If the journey began in Europe and you reached your final stop three hours or more late, you can claim, based on the full distance. Read more on our page about the delayed Air Transat flight.
Air Transat flight cancelled: refund and compensation
Most Air Transat routes to Europe are seasonal, and around one in four of our cases involves a cancellation. That gives you two separate rights.
You choose: the full fare back, or another flight to Canada at the earliest opportunity.
Paid on top of the refund if you were told less than 14 days before departure.
| Notice given | Outcome |
|---|---|
| 14 days or more | No compensation; refund or new flight only |
| 7 to 13 days | Compensation due, unless the new flight leaves no more than 2 hours earlier and lands less than 4 hours late |
| Under 7 days | Compensation due, unless the new flight leaves no more than 1 hour earlier and lands less than 2 hours late |
Retimed flight. A major schedule change announced shortly before departure can count as a cancellation. Already had your fare refunded? You may still be owed compensation: check here. More detail on our page about the cancelled Air Transat flight.
Air Transat overbooking on departures from Europe
It is rare, fewer than one in ten of our cases, but full summer flights do leave people behind. If you were flying out of the EU with a confirmed booking and checked in on time, the €600 is due immediately, along with a replacement flight or refund. If boarding was refused for a reason on your side, such as a missing Canadian eTA, there is no claim. See our guide to Air Transat overbooking.
Air Transat pilot strike: where you stand
In December 2025 the pilots' union served strike notice and Air Transat pre-emptively cancelled some flights, mainly to the Caribbean and Mexico, before a tentative agreement was reached on 9 December. If industrial action by the airline's own staff hits a flight leaving Europe, compensation is normally payable: the EU Court of Justice treats a strike by a carrier's employees as part of its normal business (case C-28/20). An air traffic control strike, on the other hand, counts as extraordinary.
Air Transat rejected your claim? The usual reasons given
Faults found before take-off are part of running a fleet, unless the manufacturer has flagged a hidden design defect.
EU Court of Justice, case C-549/07A knock-on delay is not enough on its own: Air Transat has to show an extraordinary event at the root of it.
If Air Transat pilots or cabin crew walk out, compensation is normally due; if air traffic controllers strike, it is not.
EU Court of Justice, case C-28/20True for return flights operated by Air Transat: EU 261 does not cover them.
Flights from Canada and the UK: which rules apply
For a Canadian carrier, EU 261 only works in one direction. Return flights such as Toronto–Lisbon, Montreal–Porto or Toronto–Barcelona fall outside it. On those sectors Canada's Air Passenger Protection Regulations (APPR), enforced by the Canadian Transportation Agency, may apply instead, with different conditions and amounts. Air Transat's services from London Gatwick are covered by UK261, the British version of the rules, with complaints overseen by the CAA.
Claiming from Air Transat: on your own or with DelayFlight24
On airtransat.com, delay and cancellation requests go through the "Disruptions & Recourses" area of customer service.
Free, but you deal with a North American airline yourself. If it says no, your next steps are the national enforcement body of the country where the flight departed or the courts, at your own cost and risk.
Give us the flight details and sign online. We handle the claim, the formal demand and any court action with our own lawyers. If you are paid, we keep 25% + VAT: from €600 you receive €417. Legal costs are ours, even if the case is lost.
If Air Transat has already turned you down
Send us their reply and your booking reference: if the reasoning is weak, we reopen the claim.
What to have ready
- Booking confirmationThe Air Transat reference or a boarding pass.
- PassportFor each passenger making a claim.
- Proof of the disruptionNotifications received and receipts for airport spending.
Time limits for an Air Transat claim
The deadline is set by the law of the country where the claim is brought (case C-139/11), so it varies. Flights from a few summers ago may still qualify: enter the date and we will tell you.
How long Air Transat takes to pay
When Air Transat accepts a claim, payment usually follows within a few weeks. If it refuses or goes quiet, the formal demand and any court action add a few months. Once the money arrives, we transfer your share by bank transfer.
Lost or damaged luggage on Air Transat
Baggage falls under the Montreal Convention, not EU 261. Fill in a Property Irregularity Report (PIR) at the airport, then complain in writing within 7 days for damage, or within 21 days of delivery for a delayed bag.
