In short

  • Delay: if you arrive 3 hours or more late, Belavia owes €250 to €600 per person, depending on the distance.
  • Cancellation: you are owed compensation if you were told less than 14 days before departure, on top of a ticket refund or an alternative flight.
  • Not owed for extraordinary circumstances (severe weather, air traffic control strikes). Technical faults and strikes by the airline's own staff usually are not extraordinary.
  • With DelayFlight24 you pay nothing upfront: if Belavia pays, you keep €173.75 out of €250 or €278 out of €400.

Belavia compensation: why EU261 barely applies today

Belavia is the state-owned flag carrier of Belarus, headquartered at its Minsk hub. It is a non-EU airline, so under EU Regulation 261/2004 only its flights departing from an airport in the EU, Norway, Iceland or Switzerland are covered. Belavia flights from Minsk into Europe were never covered, even when they landed in Paris or Vilnius.

The bigger issue is political. After a Ryanair flight was forced to land in Minsk on 23 May 2021, the UK suspended Belavia's permit and the EU banned Belarusian carriers from its airspace and airports, with the ban formally in force from 5 June 2021. Belavia has also been on the EU sanctions list since December 2021, and Switzerland followed suit. The airline still flies, mostly to Russia, Turkey, the Caucasus, Central Asia, the UAE and Asia, but no Belavia flight leaves the EU or the UK, so today's flights carry no EU261 compensation.

What Belavia owed on flights from the EU

Before 2021 Belavia linked Minsk with many European cities, including Rome, Milan, Barcelona, Paris, Nice, Amsterdam and the Baltic capitals; London Gatwick was also on the map in the past. For departures from EU airports the amounts were:

Distance Belavia routes departing the EU Amount
Up to 1,500 km Vilnius–Minsk, Riga–Minsk, Warsaw–Minsk €250
1,500 to 3,500 km Rome–Minsk, Paris–Minsk, Barcelona–Minsk, Nice–Minsk €400
Over 3,500 km Only on a single booking from the EU to distant points beyond Minsk €600

Each passenger, including children with their own seat, had a separate entitlement: a family of four on Paris–Minsk arriving three and a half hours late was owed €1,600 in total.

Delayed Belavia flight: what mattered

On a single booking from the EU, such as Barcelona–Minsk–Tbilisi, what counted was the delay at the final destination and the total distance, including the leg flown outside Europe. For an older trip, gather:

  1. Your booking confirmation showing the B2 flight number.
  2. Boarding passes, even photos.
  3. Emails and texts from Belavia or your agent about the delay.
  4. Receipts for meals and hotels you paid for.
  5. Any replies the airline sent you.

Care at the airport

Distance Meals and drinks after
Up to 1,500 km 2 hours
1,500 to 3,500 km 3 hours
Over 3,500 km 4 hours
Over 5 hours Fare refund if you gave up the trip

Missed connection in Minsk

On separate tickets each flight stands alone, and the onward one from Minsk isn't covered. More on our page about a delayed Belavia flight.

Belavia flights cancelled by the 2021 ban

Many travellers held Belavia tickets for summer 2021 that were scrapped when European airspace closed to Belarusian airlines.

Ticket refund

Always due for a cancelled flight from the EU: your money back or another flight.

Fixed compensation

Due with under 14 days' notice, but a ban imposed by the authorities is normally an extraordinary circumstance.

Notice Compensation
14 days or more No
7 to 13 days Yes, unless the alternative left no more than 2 hours earlier and arrived less than 4 hours later
Under 7 days Yes, unless the alternative left no more than 1 hour earlier and arrived less than 2 hours later

Retimed flight. A major schedule change at short notice could count as a cancellation. See our page on a cancelled Belavia flight.

Belavia overbooking

Denied boarding compensation applied only on flights departing the EU, alongside a new flight or a refund. It wasn't due if boarding was refused for reasons on the passenger's side, such as a missing visa or documents not valid for entry to Belarus. Read our guide to Belavia overbooking.

Belavia staff strikes

A strike by an airline's own staff isn't generally an extraordinary circumstance (CJEU case C-28/20), whereas air traffic control strikes are. For Belavia this only matters for old flights out of the EU.

Sanctions and today's flights

With Belavia on the EU sanctions list, collecting any payment is now very difficult even where the right exists. On current routes, such as Istanbul–Minsk or Dubai–Minsk, only the rules of the departure country can apply, not EU law.

Travellers reaching Minsk from Britain or the EU today usually connect through a non-EU hub such as Istanbul. The first flight from an EU airport is covered by EU261; whether the Belavia leg is depends on how the trip was booked, so enter it and we'll check.

How to claim from Belavia: yourself or with us

On your own

Write to Belavia through its official website; for flights out of the EU you can also contact the national enforcement body of the departure country, or go to court.

With DelayFlight24

Free assessment. If there's a realistic route, you pay only once money arrives: 25% + VAT, leaving you €173.75 of €250 or €278 of €400.

If Belavia has already said no

Send us the reply and we'll check whether the flight fell under the regulation.

Documents

  • BookingWith flight number and date.
  • PassportFor each passenger.
  • MessagesEmails, texts, receipts.

Time limits

Deadlines depend on the law of the country where you claim (CJEU, case C-139/11), so flights before June 2021 need careful checking.

How long it takes

There's no typical timescale for Belavia: between sanctions and older flights, each case is assessed on its own and the outcome isn't guaranteed. We tell you straight away whether it's worth pursuing and keep you updated by email if we go ahead.

Belavia baggage

Lost or damaged bags fall under the Montreal Convention: file a PIR at the airport and claim within 7 days for damage or 21 days of delivery for delay.

Belavia compensation: frequently asked questions

Is Belavia an EU airline?
No. Belavia is the flag carrier of Belarus, based in Minsk. Under EU Regulation 261/2004 it is a non-EU airline, so only its flights departing from the EU, Norway, Iceland or Switzerland are covered.
Does Belavia still fly to Europe or the UK?
No. Since 5 June 2021 Belarusian airlines have been banned from EU airspace and airports, the UK suspended Belavia's permit in May 2021, and Belavia has been on the EU sanctions list since December 2021. It now flies mainly to Russia, Turkey, the Caucasus, Central Asia, the UAE and Asia.
My Belavia flight from Minsk to Vilnius arrived 4 hours late. Can I claim?
No. The flight departed from a non-EU country with a non-EU airline, so EU261 doesn't apply, even though it landed in the EU.
My Paris–Minsk flight was cancelled when airspace closed in 2021. What am I owed?
A refund or an alternative flight. Fixed compensation is normally not due, because a ban imposed by the authorities counts as an extraordinary circumstance.
How much was due for a delayed Rome–Minsk flight before 2021?
The route is between 1,500 and 3,500 km, so €400 per passenger for an arrival delay of 3 hours or more, unless extraordinary circumstances applied.
I'm flying Belavia from Istanbul or Dubai to Minsk. Am I protected?
Not by EU261, because the flight leaves a non-EU country with a non-EU airline. Local rules of the departure country may apply, and the Montreal Convention covers baggage.
Do EU sanctions stop me getting compensation from Belavia?
They make any payment very difficult even when the right exists. That's why we assess every Belavia case individually and free of charge before taking any step.
What does DelayFlight24 charge for a Belavia claim?
The check is free. If there's a realistic route and we recover money, we keep 25% + VAT, so you receive €173.75 of €250 or €278 of €400. If we recover nothing, you pay nothing.
