Holiday Europe compensation: the airline has stopped flying, so what can you still claim?
Holiday Europe was a small Bulgarian charter airline based in Sofia. It was set up in 2019 with close ties to Turkey's Onur Air, which supplied most of its aircraft, and it flew holidaymakers for tour operators to the Mediterranean, the Canary Islands, Egypt and the UAE. It no longer operates: flights were suspended in December 2020 and the company has been inactive since 2022. If you had a Holiday Europe flight, this page explains your rights and how we can help. We still accept these claims.
As a Bulgarian company it was an EU carrier, so Regulation (EC) 261/2004 covered both its departures from the EU and its flights into Europe from outside, such as a return leg from Hurghada or Dubai.
Late return
The charter reached its destination 3 hours or more behind schedule.

You were told less than 14 days ahead, for example when operations stopped in late 2020.

What the law provided for a Holiday Europe flight
The amount had nothing to do with the price of your package holiday. Only the flight distance mattered.
| Distance | Typical holiday charter flights | Amount |
|---|---|---|
| Up to 1,500 km | Short hops to Mediterranean islands | €250 |
| 1,500 to 3,500 km | Many flights to Egypt and the Canaries, depending on the departure airport | €400 |
| Over 3,500 km | Only very long routes to non-EU countries; within the EU the cap stays at €400 | €600 |
Each traveller is entitled to the amount, including children with their own seat: a family of four on a €400 charter could claim €1,600.
Delayed Holiday Europe flight
Charter delays often build up because one aircraft flies several tight rotations to different resorts in a single day. What counts is when the doors opened on arrival. If you still need to document your trip:
- Dig out the tour operator's voucher or your boarding pass: it is often the only proof of the flight.
- Look for messages from your travel agent about the schedule change: on charters, that is where they came from.
- Piece together your arrival time using photos, texts or transfer receipts.
- Keep receipts for meals or a hotel you paid for yourself.
- Do not sign waivers offered by the tour operator in exchange for a discount.
Care at the airport
| Distance | Meals and drinks after |
|---|---|
| Up to 1,500 km | 2 hours |
| 1,500 to 3,500 km | 3 hours |
| Over 3,500 km | 4 hours |
| More than 5 hours | Give up the flight and get the ticket refunded |
Missed connection
Charters were nearly always direct, but if a second flight was on the same booking, your arrival at the final destination is what counts. More on a delayed Holiday Europe flight.
Holiday Europe flights cancelled in 2020
Between the pandemic and the halt to operations at the end of 2020, many passengers lost their departure.
Always due for a cancelled flight; with a package holiday, you claim it from the organiser.
Only with less than 14 days' notice and no extraordinary circumstances.
| Notice | Compensation |
|---|---|
| 14 days or more | No |
| 7 to 13 days | Yes, unless the replacement left no more than 2 hours earlier and arrived less than 4 hours late |
| Under 7 days | Yes, unless the replacement left no more than 1 hour earlier and arrived less than 2 hours late |
Health-related bans. If the flight was grounded by an official ban, compensation is usually not due, but a refund is. Read more about a cancelled Holiday Europe flight.
Holiday Europe overbooking
Charter seats were sold in blocks to tour operators, so denied boarding was rare. If it happened through no fault of yours, compensation was due immediately. See our guide to Holiday Europe overbooking.
Strikes and Holiday Europe flights
A strike by the airline's own crews did not let it off the hook (case C-28/20); one by air traffic controllers or airport staff did. Even then, the airline had to provide meals, drinks and, where needed, a hotel night: if you paid yourself, your receipts still matter.
Typical objections for a defunct charter airline
Maintenance is the airline's risk, even when the aircraft was leased in.
EU Court of Justice, case C-549/07An official ban is extraordinary; a flight dropped because it was half empty is not.
The right remains, but collecting from an inactive company is difficult.
Tour operators and Onur Air: who is responsible now
Holiday Europe did not sell tickets to the public: seats went through tour operators. If your flight was part of a package, the organiser is liable for the trip not being delivered as agreed. Onur Air, the Turkish partner, has also ceased trading. Before taking any step, we work out who sold the flight, who operated it and whether anyone is still in a position to pay; only then do we suggest how to proceed.
How to make a claim
You have to trace the company, write to the tour operator and, if needed, contact the national enforcement body of the country where the flight departed or go to court.
Free assessment, action with our own lawyers and a 25% + VAT fee only if you are paid: from €250 you keep €173.75, from €400 you keep €278. Legal costs are ours even if the case is lost.
If you already complained
Send us the reply from the tour operator or the airline and we will pick it up from there.
Documents
- Voucher or boarding passThe package contract helps too.
- IDFor every passenger.
- Evidence of the disruptionAgent messages, photos, receipts.
Time limits
National law sets the deadline (EU Court of Justice, case C-139/11). For flights in 2019 or 2020, check now by entering the date.
Realistic timescales
With an inactive airline we cannot promise timings: where action against the organiser is possible, it usually takes a few months. We update you by email at every step and, if money comes in, transfer your share.
Lost luggage with Holiday Europe
The Montreal Convention applies: a PIR at the airport, then a claim within 7 days for damage or within 21 days of delivery for a delayed bag. Today it is worth contacting the tour operator as well.
