Neos compensation: up to €600 for a delayed or cancelled flight
Neos is the airline of Italy's Alpitour travel group. From its main base at Milan Malpensa it flies holidaymakers around the Mediterranean and operates long-haul Boeing 787 services to Asia, Africa and North America. We have dealt with more than 140 Neos claims for over 200 passengers, from Rome–Ibiza to Milan–Amritsar and Milan–New York. If you landed 3 or more hours late, or your flight was cancelled at short notice, you could be owed €250, €400 or €600 per person, even if the flight was part of a package holiday.
Neos S.p.A. is based in Somma Lombardo, near Varese, so it is an EU airline. Regulation (EC) 261/2004 covers its departures from the EU and also its flights into Europe from India, the United States, the Caribbean or Africa.
Delay
Your Neos flight reached its final destination 3 hours or more behind schedule.
3+ hours at arrivalCancellation
You were told, by Neos or your tour operator, less than 14 days before departure.
Short noticeBumped
The flight was full and you were refused boarding despite a confirmed booking and arriving on time.
Owed on the spotExceptions
A hurricane, closed airspace or an air traffic control strike. Neos must prove the event caused your delay.
Proven force majeureEnter your route and date and we'll tell you in two minutes what you can claim. Check your Neos flight.
How much Neos pays
Because so many Neos claims involve intercontinental flights, €600 is the most common amount in our files. What you paid for the holiday makes no difference; distance does.
| Distance | Neos routes in our claims | Compensation |
|---|---|---|
| Up to 1,500 km | Rome–Ibiza | €250 |
| 1,500 to 3,500 km | Tel Aviv–Paris | €400 |
| Over 3,500 km | Milan–Amritsar, Milan–New York, Milan–Nanjing, Amritsar–Toronto | €600 |
Compensation is per traveller. Two parents and two children flying Milan–New York who arrived 3 hours 40 minutes late could claim €2,400 together; children with their own seat receive the full amount.
Neos flight delayed: what to do
More than 8 in 10 of our Neos claims are about delays, many on long-haul rotations where one technical issue can hold back hundreds of passengers. The time that counts is when the doors open at the last airport on your ticket. Our tips:
- Keep your boarding pass and booking, including the tour operator's travel documents.
- Ask the tour rep or ground staff to confirm the reason for the delay in writing.
- Write down the actual arrival time and photograph the arrivals board.
- Hang on to receipts for meals and transport if no care was provided.
- Turn down holiday vouchers offered instead of cash compensation.
Care while you wait
Whatever caused the delay, Neos must give you meals and drinks and, if you leave the next day, a hotel with transfers.
| Distance | Care after |
|---|---|
| Up to 1,500 km | 2 hours |
| 1,500-3,500 km | 3 hours |
| Over 3,500 km (Neos long-haul) | 4 hours |
| 5 hours or more | You may give up the flight and get a refund |
Missed connection on a Neos itinerary
Neos has sold Amritsar–Toronto journeys with a change of plane in Milan. On a single booking, if you reached Toronto 3 or more hours late, compensation is based on the full distance. With separate tickets, each flight is assessed on its own. Read more about Neos delay compensation.
Cancelled Neos flight: your rights
Just over 1 in 10 of our Neos cases is a cancellation, often passed on by the tour operator with a replacement flight. Accepting it does not cost you the compensation.
Always owed: take your money back or travel on a replacement.
Due as well if you were told less than 14 days before the flight.
| Notice | Compensation |
|---|---|
| 14 days or more | Not owed; refund or rerouting remain |
| 7-13 days | Owed, unless the replacement leaves no more than 2 hours earlier and lands within 4 hours of the original time |
| Under 7 days | Owed, unless the replacement leaves no more than 1 hour earlier and lands within 2 hours of the original time |
Big schedule changes. On holiday flights, departure times sometimes move by several hours just before travel; the EU Court of Justice has held that this can amount to a cancellation. Check your case or see our page on cancelled Neos flights.
Neos overbooking
Denied boarding makes up around 2 in 100 of our Neos claims, typically on full summer departures. If you were left behind against your will, Neos owes compensation straight away plus another flight. Nothing is owed if you were stopped for a missing visa, for instance for India or the US. See our guide to Neos overbooking.
Neos and strikes
When Neos pilots or cabin crew strike, compensation is normally payable, because a strike by the airline's own staff is part of its normal activity (EU Court of Justice, case C-28/20). Industrial action by air traffic controllers or airport services, in Italy or abroad, is extraordinary: you keep care and a refund or rerouting, but not compensation.
Neos refused your claim? Typical reasons
Passengers who reach us after a first refusal usually received one of these replies.
Fixing aircraft is routine airline business; only hidden manufacturing defects are an exception.
EU Court of Justice, case C-549/07A delay inherited from the previous flight needs an extraordinary event at its source to excuse Neos.
Neos crew: usually payable. Controllers or airport staff: not payable.
EU Court of Justice, case C-28/20Valid only if it hit your flight at that time; we check the operational data.
Neos flights in an Alpitour package
Many Neos passengers travel on a package sold by an Alpitour group tour operator or a travel agent. EU261 still applies: compensation for delay or cancellation is owed by Neos as the operating airline, not by the agent. Neos flies from Milan Malpensa, Rome Fiumicino, Verona, Bologna and Bergamo.
Long-haul Neos flights into Europe are covered too
As an Italian airline, Neos must pay compensation on flights arriving in the EU from outside it. Among our cases:
- India–Italy flights such as Amritsar–Milan
- New York–Milan
- flights from Dakar and Toronto
- Tel Aviv–Paris and other routes from Israel to the EU
How to claim from Neos
You can write to Neos customer service through the channels on neosair.it, quoting your flight number and booking reference.
Free, but you chase the airline yourself. If Neos won't pay, you can contact the national enforcement body of the country where the flight departed (the CAA for UK departures) or go to court.
Two-minute form, online signature. We handle the claim, formal demand and court case with our own lawyers. You pay only on success: 25% + VAT, leaving you €173.75 of €250, €278 of €400 and €417 of €600. Legal costs are ours even if we lose.
If Neos has already rejected you
We review the airline's reasoning and, if it doesn't stand up, send a formal letter of demand.
What to prepare
- Ticket or package bookingShowing the Neos flight number.
- PassportFor every traveller, children included.
- NotificationsEmails from Neos or the tour operator, receipts.
Deadline to claim
There is no deadline in EU261 itself; the law of the country where you claim decides (EU Court of Justice, case C-139/11). A holiday flight from a few years ago may still qualify: enter the date.
When Neos pays
If Neos accepts, payment usually arrives within a few weeks. If a formal demand or court case is needed, expect a few months. We then transfer your share by bank transfer.
Lost or damaged Neos luggage
Baggage is covered by the Montreal Convention. Report the problem with a PIR at the arrival airport and write to Neos within 7 days for damage, or within 21 days of delivery for a delayed bag.
