Nile Air compensation: which flights to Egypt qualify
Nile Air is a privately owned Egyptian airline based at Cairo International Airport, flying an all-Airbus fleet. European travellers usually meet it on scheduled flights to Cairo or on holiday charters to Luxor and Hurghada. We have handled claims for more than 50 Nile Air passengers, and almost nine in ten of them were about a delay. If your flight left a European airport and arrived 3 hours or more late, or was cancelled at short notice, you may be owed €400 or €600 per passenger.
There is an important limit. Nile Air is not a European carrier, so Regulation (EC) 261/2004 only applies to its flights departing from an airport in the EU, Iceland, Norway or Switzerland. Your flight home from Egypt is not covered by EU261.
Delay on the way out
Departed Europe, doors opened in Cairo, Luxor or Hurghada at least 3 hours late.
3 hours or moreCancellation
A flight from Europe cancelled with under 14 days' notice and no replacement at similar times.
Under 14 daysDenied boarding
Turned away at a European airport despite a valid ticket and checking in on time.
Due on the spotNot covered
Flights leaving Egypt, separately booked domestic Egyptian flights, and genuine extraordinary circumstances.

How much Nile Air pays: €400 or €600
From most of Europe, Egypt is more than 1,500 km away, so the €250 band rarely applies. These are the routes that come up most in our claims.
| Distance | Nile Air routes from Europe | Amount |
|---|---|---|
| 1,500 to 3,500 km | Milan Bergamo–Cairo, Budapest–Hurghada, Lyon–Luxor | €400 |
| Over 3,500 km | Madrid–Luxor, Paris–Luxor | €600 |
The fare or package price is irrelevant: only distance matters. Every passenger gets the full amount, including children with their own seat, so a family of four on a Paris–Luxor flight that landed four hours late could claim €2,400. Enter the flight once on our form and add your companions.
Delayed Nile Air flight: what to do at the departure airport
Delays are by far the most common problem with Nile Air. Typically the aircraft is late arriving from Cairo, so the outbound leg leaves Europe late as well. While you wait:
- Keep your boarding pass, paper or on your phone, as proof you were on that flight.
- Ask ground staff or your tour rep to put the reason for the delay in writing.
- Photograph the departures board and note when the doors open at your destination.
- Keep receipts for food and drink if no refreshments are offered.
- Don't sign anything from the airline or tour operator that waives your rights.
Care at the airport
On flights from Europe, Nile Air must provide meals and drinks and, for overnight delays, a hotel and transfers, even when no compensation is due.
| Distance | Care after |
|---|---|
| Up to 1,500 km | 2 hours |
| 1,500 to 3,500 km | 3 hours |
| Over 3,500 km | 4 hours |
| More than 5 hours | You may abandon the trip and get your fare back |
Connecting in Cairo
On a single booking such as Milan Bergamo–Cairo–Luxor, what counts is your arrival in Luxor: 3 hours late or more and compensation is based on the distance to your final destination, here €400. If the domestic leg was a separate ticket, it is not covered. More on our page about the delayed Nile Air flight.
Cancelled Nile Air flight: refund and compensation
Around one in ten of our Nile Air claims involves a cancellation, often of seasonal flights to the Red Sea.
Always owed: choose between your money back and another flight to Egypt.
Added if the flight was leaving Europe and you were told less than 14 days before.
| Notice | Compensation |
|---|---|
| 14 days or more | No, but refund or rerouting remain |
| 7 to 13 days | Yes, unless the replacement leaves no more than 2 hours early and lands less than 4 hours late |
| Under 7 days | Yes, unless the replacement leaves no more than 1 hour early and lands less than 2 hours late |
Holiday flight retimed? If your tour operator tells you a few days before that the Nile Air departure has moved by many hours, it may count as a cancellation. See our page on the cancelled Nile Air flight.
Nile Air overbooking
We have had no overbooking cases with Nile Air so far, but if you are bumped at a European airport, compensation is due at once alongside a new flight. It does not apply if you were refused boarding for an invalid passport or a missing Egyptian visa. Read our guide to Nile Air overbooking.
Strikes and Nile Air flights
If a flight is cancelled because Nile Air's own staff strike, the EU Court of Justice has made clear this is not an extraordinary circumstance (case C-28/20): on flights from Europe, compensation is still owed. A strike by air traffic controllers or airport staff in Europe rules out compensation, though not care.
Nile Air refusing to pay? Typical replies
A knock-on delay of the same aircraft comes down to how the airline plans its rotations, unless Nile Air proves an extraordinary event started it.
Faults and maintenance on its Airbus fleet are part of normal operations, barring manufacturing defects.
EU Court of Justice, case C-549/07True for flights from Egypt to Europe. If the disruption was on your outbound flight, you are still owed compensation.
It can be extraordinary, but it has to be proven for that flight at that time.
Charter flights and package holidays with Nile Air
Many Nile Air flights from Europe to Hurghada and Luxor are charters sold by tour operators as part of a package. EU261 still applies: compensation is owed by the operating airline, Nile Air, not the travel company. The tour operator remains responsible for your hotel and services on the ground.
What EU261 does not cover with Nile Air
- return flights from Cairo, Luxor or Hurghada to Europe;
- domestic Egyptian flights such as Cairo–Luxor, unless part of a single booking that started in Europe;
- Nile Air flights between Egypt and countries outside Europe.
Claiming from Nile Air: on your own or with us
You write to an Egyptian airline and wait for a reply that may never come. If it refuses, your options are the national enforcement body of the departure country or the courts.
Give us the details in two minutes and sign online. We handle the claim, formal demand and court action with our own lawyers. You pay 25% + VAT only if you're paid; legal costs are ours even if a case is lost.
If Nile Air has already said no
We check where the flight departed from and what actually happened. If the refusal doesn't stand up, we send a formal demand.
Documents to have ready
- Ticket or tour operator voucherShowing the flight number and date.
- PassportFor every traveller.
- Evidence of the delayMessages from the tour operator, photos of the board, receipts.
Time limits
EU261 has no deadline of its own: national rules in the country where you claim apply (EU Court of Justice, case C-139/11). An Egypt trip from a few years ago may still be claimable: enter the date.
How long a Nile Air payout takes
If Nile Air accepts, payment usually arrives within a few weeks. With non-EU airlines a formal demand or court case is needed more often, and that adds several months. We update you at each step and transfer your share by bank transfer.
Lost or damaged bags on Nile Air
Luggage is governed by the Montreal Convention. Fill in a PIR at the baggage office on arrival, then write to Nile Air within 7 days for damage or within 21 days of delivery for a delayed bag.
