AlbaStar compensation: your rights on charter flights
AlbaStar is a Spanish charter airline headquartered in Palma de Mallorca, flying Boeing 737s for tour operators, holiday companies and pilgrimage organisers. Few people book AlbaStar directly: the flight usually comes as part of a package to Majorca, the Red Sea or Cape Verde. That doesn't reduce your rights. We have dealt with more than 100 AlbaStar claims, including many from holidaymakers flying between Majorca and Edinburgh, Cork or Norwich.
AlbaStar is an EU airline, so Regulation (EC) No 261/2004 protects you on every AlbaStar flight leaving the EU and also on flights into the EU from outside it, for example from Edinburgh, Egypt or Cape Verde. Depending on distance you could receive €250, €400 or €600 per passenger.
Delayed charter
The aircraft door opens at your destination 3 or more hours after the scheduled arrival.
At least 3 hoursCancelled flight
Your tour operator or AlbaStar tells you less than 14 days ahead, with no replacement at similar times.
Late noticeLeft at the gate
You were refused boarding against your will despite valid documents and being on time.
Due immediatelyNo payout
When an event outside the airline's control caused the problem and AlbaStar can prove it.
Proven extraordinary eventHave your holiday paperwork but not sure where to start? Enter the flight and date and we'll tell you if compensation is due.
How much AlbaStar pays on holiday routes
The price of your package is irrelevant: compensation is based only on how far the flight goes.
| Distance | AlbaStar route examples | Compensation |
|---|---|---|
| Up to 1,500 km | Pilgrimage flights such as Milan–Lourdes or Rome–Lourdes | €250 |
| 1,500 to 3,500 km | Palma de Mallorca–Edinburgh, Cork–Palma de Mallorca, Marsa Alam–Milan | €400 |
| Over 3,500 km | Sal (Cape Verde)–Bergamo | €600 |
Multiply by the number of travellers: children with their own seat get the same as adults. Two parents and two children back from Palma to Edinburgh 4 hours late could claim €1,600 between them. On a Sal–Bergamo flight, 3 hours or more at arrival means €600 each.
AlbaStar delay: what to do before you fly home
About 8 in 10 of the AlbaStar claims we handle are delays, often because the aircraft is running late from its previous rotation. Here's how to prepare:
- Keep your travel documents from the tour operator showing the AP flight number, plus your boarding pass.
- Ask your rep at the airport why the flight is late, and save any texts or group messages.
- Note the time you got off the aircraft at Edinburgh, Cork or wherever you landed.
- Take any meal vouchers on offer; otherwise pay and keep the receipts.
- Don't sign anything from the tour operator that waives your rights.
Care at the airport
AlbaStar must provide food and drinks during the wait and accommodation if the flight is pushed to the next day, even where the delay doesn't lead to compensation.
| Distance | Care after |
|---|---|
| Up to 1,500 km | 2 hours |
| 1,500 to 3,500 km (e.g. Cork–Palma) | 3 hours |
| Over 3,500 km (e.g. Sal–Bergamo) | 4 hours |
| Delay over 5 hours | Refund if you decide not to travel |
Missed connections
If your AlbaStar flight was on a single booking with an onward flight and you reached your final destination 3 or more hours late, the amount is based on the whole journey. More detail on our page about AlbaStar delay compensation.
AlbaStar flight cancelled
Almost 2 in 10 AlbaStar claims we see concern cancellations, sometimes announced by the tour operator just days before departure.
You can choose another flight to your destination or a refund of the flight part of the price.
€250 to €600 per person if you were told about the cancellation less than 14 days before.
| Notice received | Compensation |
|---|---|
| 14 days or more | Not due |
| 7 to 13 days | Due, unless the new flight leaves up to 2 hours earlier and lands less than 4 hours late |
| Less than 7 days | Due, unless the new flight leaves up to 1 hour earlier and lands less than 2 hours late |
Charter time changed? A move of several hours announced close to departure may count as a cancellation. See our page on AlbaStar cancellation compensation.
AlbaStar overbooking
Denied boarding is very rare with AlbaStar, as seats are usually sold in blocks to tour operators. If it does happen against your will, compensation must be paid straight away along with an alternative flight. Read our guide to AlbaStar overbooking and denied boarding.
AlbaStar strikes: when you get compensation
A walkout by AlbaStar pilots or crew doesn't let the airline off the hook: the Court of Justice of the EU sees it as an internal matter, not an extraordinary circumstance (case C-28/20). An air traffic control strike in Spain, France or elsewhere is extraordinary: no compensation, but care and re-routing remain due.
AlbaStar rejected your claim? What to look at
With a small Boeing 737 fleet a breakdown hits the schedule hard, but it remains the airline's operational risk.
Court of Justice of the EU, case C-549/07A delay rolling on from an earlier flight isn't enough on its own: an extraordinary event must be shown at the root.
The package belongs to the tour operator, but delay and cancellation compensation is owed by the airline that flew you.
Can be extraordinary if they really affected that flight; we check against airport data.
Charters, tour operators and pilgrimages
AlbaStar mainly flies for tour operators, travel agencies and organisers of religious trips. Your contract is with whoever sold you the holiday, but for delays, cancellations and denied boarding AlbaStar is the one that pays. All you need is the flight number, starting with AP, and the date.
Flights from the UK, Egypt and Cape Verde
Because AlbaStar is Spanish, return flights into the EU from non-EU countries are covered too:
- Edinburgh to Palma de Mallorca, which is also covered by UK rules as it departs the UK
- Marsa Alam and other Red Sea airports to Milan
- Sal in Cape Verde to Bergamo or Milan
Claiming from AlbaStar: yourself or with us
The albastar.es website has a "Reclamaciones" page in its assistance section, with information on delays and cancellations.
No cost, but you deal with a Spanish airline yourself and, if it won't pay, go to the national enforcement body of the country where the flight departed (the CAA for UK departures) or to court.
Online form and digital signature. We take care of the claim, formal demand and any court case with our own lawyers. You pay only if you're paid: 25% + VAT. Legal costs are ours even if we lose.
Already holding a rejection?
Forward us the reply from AlbaStar or your tour operator. We assess it and, if it isn't justified, start again with a formal demand.
Documents
- Travel documents or boarding passShowing flight number and date.
- IDFor every traveller.
- Messages receivedFrom the tour operator or airline, plus expense receipts.
Deadlines
The time limit isn't set by the Regulation but by the law of the country where you claim (Court of Justice of the EU, case C-139/11). A holiday from a few years back may still be recoverable: check it in two minutes.
When AlbaStar compensation arrives
If the airline accepts quickly, it generally takes a few weeks. If AlbaStar resists, a formal demand and possible court action stretch it to a few months. We keep you informed and pay your share as soon as we receive it.
Damaged or delayed luggage with AlbaStar
The Montreal Convention applies here. Fill in a PIR at the airport baggage office straight away, then send a written claim within 7 days for damage or within 21 days of delivery if your case arrived late.
